This Privacy Statement outlines how we collect, store and use personal information across BLACKROC ("we", “us”, “our” or “BLACKROC”) and all related entities (including BLACKROC Talent Pty Ltd, ABN 47 627 080 933 and BLACKROC Contingent Pty Ltd, ABN 34 669 663 487).

What is this Privacy Statement about?

BLACKROC respects your rights to privacy. We know your privacy is important to you and that’s why we are committed to protecting it and are clear and open about what we do with it. 

We only collect the personal information we need to that is reasonably necessary for the activities directly related to our core business operations.  

This Privacy Statement is developed in accordance with The Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth).

What is your Personal Information?

“Personal Information” is a term defined in the Australian Privacy Act 1988 (Cth) as any information that can be used to personally identify you. It may range from the very sensitive (e.g. medical history or condition) to the everyday (e.g. address and phone number). If the information we collect personally identifies you, or you are reasonably identifiable from it, the information is considered Personal Information.

What kinds of Personal Information do we collect and hold?

The Personal Information that we may collect, and hold includes but is not limited to:

  • your identity (your full name, previous names, evidence of change of name, gender and date of birth);
  • evidence of your right to work in Australia which may include a photograph, nationality, place of birth, birth certificate, driving licence, etc;
  • contact details including your email, home address and phone numbers so that we can contact you;
  • bank account, superannuation details and tax file number;
  • your job search criteria, preferences and expectations;
  • your qualifications, skills, experience and training;
  • current and desired remuneration/payrate and other benefits;
  • educational history; employment history;
  • references; and
  • any other personal information you voluntarily provide to us during the course of interacting with us.

We may also collect sensitive information. Sensitive information is a special category of personal information under the Australian Privacy Act 1988 (Cth). It is information or an opinion about you, including racial or ethnic origin; political opinions; membership of a political association; religious beliefs of affiliations; philosophical beliefs; membership of a professional or trade association; membership of a trade union; sexual orientation or practices; or criminal record. We will only collect this information from you if it is necessary to facilitate recruitment. We will only collect this type of Personal Information with your consent. 

In your interactions with us, we may include links to various third-party websites. If we do that, the third parties will be responsible for their content and what they do with any Personal Information they collect. 

If you do not wish to provide any information that we are requesting as part of our services, please inform us.

How do we collect your Personal Information?

We collect Personal Information directly from you unless it is unreasonable or impracticable to do so or unless other wise expressly authorised by you. When we collect Personal Information, this may happen in several ways including but not limited to:

  • when we meet with you in person;
  • when you’re visiting our website;
  • when you apply for a job on our website;
  • when you engage with us via social media; or
  • when you communicate with us via email, phone, SMS or in writing.

Sometimes we also collect Personal Information about you from other sources, for example, when you apply for a job vacancy via Seek or LinkedIn, or when we are completing a reference check. 

We may also collect information about you from publicly available sources, such as social media. When we collect Personal Information about you from publicly available sources for inclusion in our records we will manage the information in accordance with the Australian Privacy Principles (APP). 

We will also receive information about you when we receive the results of any competency, medical test or any background check. BLACKROC will usually require you to provide signed consent to enable us to obtain personal data from third parties, unless consent is given in another way.

How do we use your Personal Information?

We collect your Personal Information and only use it for the purpose for which it was provided to us, other related purposes (and, in the case of sensitive information, directly related purposes) or as permitted or required by law. 

We collect, use, hold and disclose your personal information that is reasonably necessary for our functions or activities as a recruitment agency including but not limited to;

  • Recruitment and placement services
  • Contractor management
  • Verifying employment history and work rights
  • Communicating job opportunities and career advice
  • Client relationship and service management
  • Internal reporting and improvement of services
  • Legal and regulatory compliance
  • For any other reason that you engage BLACKROC

What happens if you do not provide us with the information we require?

If you choose not to provide Personal Information that we request in connection with our business functions and activities, we may not be able to provide you with the services or assistance you require as part of your job search.

How we store and protect your Personal Information

Protecting your privacy is a priority for us. We take reasonable and appropriate steps to safe guard your personal information from misuse, interference, loss, unauthorised access, modification or disclosure regardless of how you interact with us.

Your information may be stored in electronic format and is head in held in secure systems with restricted access. Access to Personal Information is granted only to authorised personnel who are bound by confidentiality obligations and must adhere to our privacy and security protocols.

We retain personal information only for as long as necessary to provide recruitment services or to meet legal and regulatory requirements. When it is no longer required, we securely destroy or de-identify the information, provided it is lawful to do so.

Our technical and organisational security measures are designed to protect your personal data from accidental or unlawful loss, alteration, destruction, or unauthorised access. These measures include data access controls, encryption, secure storage solutions, and staff training on privacy obligations.

While we make every effort to secure your personal data, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee the security of information transmitted to us online, and you do so at your own risk.

Who we share your Personal Information with and why?

Personal Information that is held about individuals is only disclosed for the primary purpose for which it was collected or where we are under a legal duty to do so.  

Disclosure will usually be:

  • Internally and to any BLACKROC legally related entity.
  • To our clients for consideration for vacant positions.
  • To referees for job suitability purposes.
  • To ensure continuity of service, to another company if the supply ofthe service has been transferred to that company.
  • To applicable Government agencies as required by law.

We outsource a number of our business activities to contracted suppliers. As a consequence of this outsourcing our suppliers may see some personal information. Typically, our suppliers include:

  • Legal and other professional advisors.
  • Accredited auditors.
  • Superannuation fund managers.
  • Background checking and screening consultants.
  • Software solution providers for the purposes of parsing resume data into our database, and the creation and administration of any online profile.

Third parties that request access to individual's Personal Information (e.g. employment history checks) will only be granted access based on the individual's written consent. Unless required or permitted to do so by law, BLACKROC will not otherwise share, sell or distribute any of your Personal Information without your consent or use it for any purpose which is not related to the service we provide or in a manner that you would reasonably expect us to use it. 

We do not disclose your information overseas unless required by our technology providers. In such cases, we ensure adequate data protection consistent with Australian standards.

What we do if there’s a breach?

If we believe there’s been a privacy breach, we’ll identify the issues and take steps to minimise any harm.

If we believe the breach has caused, or is likely to cause, serious harm, we’ll contact the relevant Privacy Commissioner, and we may also contact the individuals who may be affected. 

If you believe there has been a privacy breach affecting you, please contact us as soon as possible. Access and correction of your personal Information.

Access requests and correction

You have the right to access your Personal Information which we hold about you, subject to some exceptions. You can only request information about yourself. Before we provide you with access to your personal information, we may require some proof of identity. If you wish to access the Personal Information we hold about you, please contact us using the details provided in the ‘How to contact us’ section of this Statement.

You also have the right to request that we correct any inaccurate Personal Information we hold about you, subject to some exceptions. If you wish to correct the Personal Information we hold about you, please contact us using the details provided in the ‘How to contact us’ section of this Statement.

If we do not agree to your request to provide you with access to your Personal Information or to amend your Personal Information, we will inform you of our decision within a reasonable period. If you wish to complain about this outcome or to attach a statement to your record that you believe the personal information we hold about you is inaccurate, out-of-date, incomplete, irrelevant or misleading, please see our complaints procedure in the ‘Complaints’ section of this document.

Withdrawing consent and deletion

You may request to withdraw consent for the use of your Personal Information or request its deletion by contacting BLACKROC. We will take reasonable steps to comply unless legal obligations require us to retain certain information.

Complaints

You may request further information about the way we manage your Personal Information or lodge a complaint by contacting us using the contact details in in the ‘How to contact us’ section of this Statement.

In some cases, we may need to ask you to put your complaint in writing so that we are sure that we understand it and may also need to ask you for further information or to verify your identity.

We will investigate your complaint and will provide our response within 30 days.

If you are not satisfied with the response that you receive from us, you may have the right, depending on the jurisdiction, to make a complaint to the Office of the Australian Information Commissioner (OAIC). Change of ownership

In the event of a change of ownership of all or a portion of our business or the website, your Personal Information may be transferred to the new owner so that the business and/or website can continue operations.

Amendments to this Statement

We may modify this Privacy Statement at any time. If we do, we will post the updated Privacy Statement on our website www.blackroc.co (the “website”).
